Acquisition of permanent residence (F-5) qualification

① A person who has been in Korea for at least five years as an adult pursuant to the Civil Act of the Republic of Korea *Attachment 1-2 from 10. (D-7) to 20. Specific activities (E-7) or 24.2 in attached Table 1-2

② A person who has stayed in Korea for more than two years as a spouse or minor child of a national or permanent resident status (F-5) or a person who has applied for the status of residence pursuant to Article 23 of the Act on the grounds of his/her birth and is recognized by the Minister of Justice at the time of birth as a permanent resident status (F-5)

③ A foreign investor who has invested US$500,000 in accordance with the Foreign Investment Promotion Act and employs five or more citizens

④ 26-2 in attached Table 1. A person who has stayed in the Republic of Korea for more than two years with the status of residence of overseas Koreans (F-4) and is deemed necessary by the Minister of Justice to continue living in the Republic of Korea

⑤ A person who meets the requirements for acquiring nationality under the Nationality Act as a foreign national citizen referred to in subparagraph 2 of Article 2 of the Act on the Immigration and Legal Status of Overseas Koreans

⑥ A person who has lived (including a person who has previously had a status of residence (including a person who has previously had a status of residence (including a person who has previously had a status of residence) in column 27 of attached Table 1 (referring to those who have previous status of residence) under the Enforcement Decree of the Immigration Control Act (Presidential Decree No. 17579 and was partially amended and promulgated and enforced on April 18, 2002) and is deemed necessary by the Minister of Justice to continue living in the Republic of Korea

⑦ A person recognized by the Minister of Justice as a person who falls under any of the following items

A. A person who has obtained a doctorate in a certain field abroad and is employed by a domestic company, etc. when applying for permanent residence (F-5)

B. A person who has completed a regular course at a domestic graduate school and obtained a Ph.D

⑧ A person who has a bachelor's degree or higher in the field determined by the Minister of Justice or a technical certificate determined by the Minister of Justice, who has stayed in Korea for at least three years, and is employed by a domestic company when applying for permanent residence (F-5) and is paid more than the amount determined by the Minister of Justice

⑨ A person recognized by the Minister of Justice among persons who have outstanding abilities in a specific field, such as science, management, education, culture, arts, and sports

⑩ A person recognized by the Minister of Justice for a special contribution to the Republic of Korea

⑪ A person who is 60 years of age or older and receives a pension from outside the country not exceeding the amount prescribed by the Minister of Justice

⑫ 29. A person who is engaged in employment activities with the status of residence in the visiting employment (H-2) in attached Table 1-2 and 24. A person recognized by the Minister of Justice in consideration of the length of service, employment area, characteristics of the industrial sector, the shortage of manpower, and the preference of the public for employment

⑬ 24 of attached Table 1-2 A person who has stayed in the Republic of Korea for more than three years with the status of residence (F-2) falling under subparagraph (Jo), and who is recognized by the Minister of Justice that it is necessary to continue living in the Republic of Korea

⑭ 24 of attached Table 1-2 A person who has remained invested for more than five years after receiving the status of residence (F-2) subparagraph (j), and who the Minister of Justice recognizes that it is necessary to continue living in the Republic of Korea, his/her spouse, and children (only children who meet the requirements prescribed by the Minister of Justice)

⑮ 11. A person who has stayed in Korea for more than three years with a status of residence falling under subparagraph (D-8) of attached Table 1. A person who has attracted more than 300 million won in investment from investors and employs two or more citizens. A person who has invested more than the amount determined and publicly announced by the Minister of Justice on the condition that he/she maintains his/her investment for at least five years

⑯ A person who has invested more than the amount determined and publicly announced by the Minister of Justice on the condition that the investment status is maintained for at least five years and meets the requirements prescribed by the Minister of Justice

⑰ 11. A person recognized by the Minister of Justice as a person who has stayed in Korea for more than three years as an essential professional of R&D facilities under Article 25 (1) 4 of the Enforcement Decree of the Foreign Investment Promotion Act with the status of residence falling under subparagraph (A) of corporate investment (D-8) in attached Table 1-2

⑱ 24. A person who has stayed in Korea for at least two years with the status of residence falling under item (F-2) of attached Table 1-2

Requirements for permanent residence (F-5) of marriage immigrants

In the case of continuing a marriage relationship with a Korean spouse

When a Korean spouse is declared dead or missing by the court

Where a person who is divorced from or separated from a Korean spouse can prove that the reason attributable to the divorce or separation lies with the Korean spouse

In the case of raising a minor born by marriage to a Korean spouse regardless of the reason for divorce or separation

Advantages in obtaining permanent residency

You don't have to give up the nationality of your home country.

You can participate in the local election of your address three years after the date of your permanent residence status.

If you wish to re-enter the country within two years from the date of departure, you do not need to obtain a re-entry permit.

Cancellation of permanent residence status (Article 89-2 of the Immigration Control Act)

Even if a permanent resident status has been acquired, the permanent resident status may be canceled if the following reasons arise.

Where a permanent resident status is obtained by false or other fraudulent means

Where a sentence of imprisonment or imprisonment for at least two years is confirmed for committing a crime prescribed by Ordinance of the Ministry of Justice, such as the Criminal Act and the Special Act on the Punishment, etc. of Sexual Violence Crimes

Where a person is sentenced to imprisonment or imprisonment in violation of this Act or any other Act within the last five years and the combined period of imprisonment is three years or more

Where a person prescribed by Presidential Decree, such as a person who has acquired a permanent residence status on the condition that he/she shall maintain an investment status in the Republic of Korea at least a certain amount, violates the relevant conditions

In the case of committing an act contrary to the national interests of the Republic of Korea in terms of national security, diplomatic relations, national economy, etc
