Acquisition of nationality

Nationality Acquisition Requirements

If you meet the requirements for each qualification as a subject below, you can apply for naturalization permission (acquisition of nationality) at the Immigration and Foreign Office (office) under the jurisdiction of your address (including the East Sea and Sokcho branch offices). The necessary documents should be carefully prepared by referring to the information yard (nationality/naturalization) on the e-government website (www.hikorea.go.kr ) for foreigners.

A person who has a residence in Korea for more than five years and is eligible for permanent residence in the Republic of Korea

Where a foreigner whose father or mother was a citizen of the Republic of Korea, whose father or mother was born in the Republic of Korea, and adopted by a citizen of the Republic of Korea after coming of age, has lived continuously for more than three years

Where he/she has lived in a state of being married to a Korean citizen for more than two years, or where he/she has lived in a state of being married for more than one year after three years

A person whose wealth or mother is a citizen of the Republic of Korea

If the father or mother is a naturalized person, the child can apply for a special naturalization permit regardless of age, marital status, and period of residence in Korea. (However, those who have been adopted after reaching adulthood)

Where there is a special contribution to the Republic of Korea

Where it is recognized that a person with excellent ability will contribute to the development of the Republic of Korea

Requirements for Acquisition of Nationality of Marriage Immigrants

  • Where he/she has lived in the Republic of Korea continuously for more than two years while married to a spouse who is a citizen

    In the case of continuing to live in the Republic of Korea for more than one year after three years have passed since marrying the spouse

    A person who has been married to a Korean and has been unable to live a normal marriage without the death, disappearance, or other reasons attributable to him/her, and has met the period of residence under subparagraph 1 or 2 above

    A person who is raising or is required to raise a child of a minor born according to a marriage with a Korean spouse and has met the period of residence under subparagraphs 1 or 2 above


    Supplementary documents
    Application for naturalization permission (attached one color photo 3.5cm x 4.5cm, can be downloaded from the website)

    Passport, original and copy of your home country ID (China includes a family register)

    Certificate of criminal history in the home country (publicly confirmed)

    One copy of the Korean spouse's family relationship certificate, basic certificate, marriage relationship certificate, and resident registration

    If a child is born during marriage, additional family relationship certificate in the name of the child (name) shall be submitted

    Documents proving that you or your family members who share a living are capable of maintaining a living (example below)

    Proof of deposit balance of KRW 30,000,000 or more in the name of the person or the family living together

    A certified copy of the real estate register (original) or real estate lease contract (original and copy) equivalent to more than 30,000,000 won in official land price

    Documents that can prove a certain income, such as a certificate of employment of the principal or spouse (attached with a copy of the business owner's business registration card)

    Family relations notices to be notified to the Supreme Court (can be downloaded from the www.hikorea.go.kr website) and documents proving family relations in their home country (with Korean translation attached)

    It refers to the explanatory data of the applicant's parents, spouses, children, marriage or unmarried, adoption, etc., and in the case of China, a family register and a certificate of affiliated relations (required certification by the Ministry of Foreign Affairs of China) are submitted

    Identification that Korean-Chinese (Korean) are Korean-Chinese (Korean) identification (resident identification card, family register, etc.)

    Fee: KRW 300,000 (whether it is government income)

    In the case where the marriage relationship with the Korean spouse is cut off, documents proving this

    A court ruling stating that if a Korean spouse goes missing, a death certificate if he or she dies, and that if he or she is divorced or separated from the Korean spouse, the Korean spouse has reasons attributable to him or her

    In the case of raising a Korean child after the marriage with the Korean spouse is cut off, a family relationship certificate in the name of the Korean child (name) and documents confirming that the child is being raised or must be raised

 

 

                    If there is no reason for divorce or separation from marriage

                    immigrants, extension of stay, permanent residence

                   Additional documents required to apply for qualification and nationality

                    (at least one of the following)

  • Criminal judgment or divorce judgment (in the case of divorce judgment, the husband's fault must be indicated)

    Case where the spouse's assault, etc. is sued: Decision on non-prosecution by the prosecution (no suspension of prosecution or right to prosecute)

    When a spouse hits you: Hospital certificate (must show what you got from the other party), a picture of the wound

    Where the spouse is economically incompetent: the spouse's bankruptcy decision, etc

    Where you don't know where your spouse is: A copy of the spouse's expulsion stating the fact that he/she has been declared missing

    A confirmation letter explaining the cause of the suspension of the marriage relationship prepared by a relative within the fourth cousin of the spouse

    A confirmation prepared by the head of the Tong (Ban) in the area where he lived when the marriage relationship was cut off, explaining that the spouse was the cause of the marriage relationship break (must explain the specific cause and progress of the marriage relationship break)

    Other documents equivalent to each of the above items: "Confirmation of Authorized Organizations", etc

Acquisition of nationality

1. Application for naturalization permission

The application for naturalization permission shall be filed and received by the applicant at the Immigration and Foreign Affairs Office (office) (including the East Sea and Sokcho branch offices) under the jurisdiction of the address by preparing the above required documents.

 

2. a naturalization examination

Upon application, procedures such as document review, interview review, and fact-finding will be carried out.

If the address is changed after the application by individual notification two to four weeks before the interview review date, the change of place of stay must be reported to the competent Immigration and Foreigners' Office (office).

Marriage immigrants who maintain normal marriage life are exempted from the comprehensive evaluation of social integration programs, and through interviews, they will examine their Korean language skills and basic literacy as a Korean citizen.

※ Comprehensive evaluation of social integration programs is not exempted in the case of marriage breakers.

If you fail the first interview, you can go through one more interview (you will be given a total of two opportunities)

 

 

3. Notification of the results of naturalization permission

As a result of the naturalization examination, if the permission is decided, it is necessary to participate in the ceremony for awarding a certificate of nationality (notification of the schedule in advance at the immigration and foreign office having jurisdiction over the address). Korean nationality is acquired by receiving a naturalization certificate after a national seal at the ceremony. The period required for naturalization examination is announced monthly on the website of the Immigration and Foreign Policy Headquarters or on the 'Comprehensive Nationality Information' of Kakao Talk Plus Friends.

After receiving the naturalization certificate, make sure that the entries such as the name and date of birth on the naturalization certificate are correct.

4. Abandonment of foreign nationality (the Embassy of the Republic of Korea) or Convention on Non-Proliferation of Foreign Nationality (Import/Foreign Office)

You must pledge to the Minister of Justice that you will not give up your foreign nationality or exercise your foreign nationality in the Republic of Korea within one year from the date of permission.

-If a year passes, the nationality of the Republic of Korea is lost, and if you want to acquire the nationality of the Republic of Korea again, you must take steps such as re-acquisition of nationality or restoration of nationality after reporting the loss of nationality.

In the case of giving up foreign nationality, a certificate of abandonment issued by the embassy is submitted to the immigration and foreign government offices, and a certificate of abandonment of foreign nationality is issued.

- Contact the embassy for documents, etc. necessary for giving up nationality

A foreign national non-compliance pledge can only be made if the marriage relationship is maintained, and a certificate of confirmation of the foreign national non-compliance pledge is issued after the pledge.

- You can maintain your nationality in your home country if you submit a letter of non-compliance with foreign nationality, but you are treated only as a Korean in Korea. For example, Korean passports are used at domestic airports and ports of entry and exit.

In the case of a country that does not recognize multiple nationalities (China, etc.), the original nationality may be lost according to the laws of the country concerned. (Ask the embassy of the home country for permission of multiple nationalities.)

 

5. a resident registration report

A resident registration card can be issued by visiting the Eup/Myeon office or Dong community center where you live with a certificate of renunciation of foreign nationality, a certificate of contract for foreign non-exercise, and two photos (3cm×4cm).

6. Return of alien registration card (entry/export/foreign office (office)-Mail delivery is also possible)

Return the alien registration card within 30 days after completing the resident registration (fines will be imposed after 30 days)

If you wish, you can return your alien registration card in advance when you receive a certificate of renunciation of foreign nationality or a certificate of agreement on a foreign national non-exercise.

Issuance of a resident registration card

After acquiring nationality and completing the resident registration report, you will receive a resident registration card. A resident registration card proves yourself as a Korean. It is required to verify your identity when using various reports, civil petition documents, and administrative services from administrative agencies.

 

 

                  Lend your resident registration card to another person or give your

                   resident registration number to another person

                 Be careful because there is a risk of being used for a crime if you let them

                 know.

Reissuance of resident registration card: If you lose your resident registration card, you can apply at the Eup/Myeon office or Dong community center under the jurisdiction of your address with one photo (3cm x 4cm) taken within the last six months.

Where moving: Within 14 days of moving, a notification of relocation shall be made to the Eup/Myeon office or Dong community center under the jurisdiction of the newly moved address.

 

 

                 If you don't report to the place where you live, your resident registration

                 will be canceled through fact-finding
